What is a Shop and Establishment License?

Every state in India has a Shops and Establishments Act that governs working conditions, wages, holidays, and employment terms in commercial premises. The Shop and Establishment License (also called Gumasta in Maharashtra) is proof that your business is registered with the local labour authority.

Who needs it?

  • Any commercial establishment with a physical premise — shop, office, restaurant, warehouse
  • Service businesses: salons, clinics, consultancies, cafes, co-working spaces
  • Online businesses with a registered office in the state
  • Applies whether you have 1 employee or 100

Why is it required?

  • Bank account opening for the business
  • GST registration proof (sometimes)
  • Basis for complying with working-hours, leave, and wage regulations
  • Required for shop signboards and municipal approvals
  • Proof of business existence during loan applications

Documents needed (typical)

  • Owner PAN and Aadhaar
  • Passport-size photo
  • Shop / office address proof (rent agreement + NOC or ownership deed)
  • Partnership deed / incorporation certificate (if applicable)
  • List of employees with names, designations, salaries
  • Utility bill of the premise

Application process

  1. Visit your state Labour Department portal
  2. Create a user profile
  3. Fill the application with business and premise details
  4. Upload documents
  5. Pay the fee (₹100–₹2,000 typically, based on employee count)
  6. License is often issued within 7–15 working days

Validity and renewal

  • 1 to 10 years depending on state rules
  • Some states (like Karnataka) now allow lifetime registration
  • Renew before expiry — late renewal attracts penalties

What the license regulates

  • Working hours — typically 9 hours/day, 48 hours/week
  • Overtime — paid at 2x rate beyond statutory hours
  • Weekly off and annual leave
  • Wage payment — monthly, by the 7th of the following month
  • Holidays — national + state festivals
  • Women working hours — special rules for night shifts
  • Display of license at the premise

Penalties

  • Operating without license: ₹1,000–₹50,000 depending on state
  • Non-display: ₹500–₹5,000
  • Wage / hour violations: compensatory damages + fines
